18-Wheeler Accident

Facts:
On February 16, 2007, a husband and wife were on their way home to Hondo, Texas when suddenly and without warning an individual driving an 18-wheeler slammed into the rear-end of their vehicle causing them to lose control, go off the side of the road, strike a sign, comeback onto the roadway, only to be struck again by the 18-wheeler which propelled them into a tree.

According to the Texas Department of Public Safety Trooper who investigated this accident, the driver of the 18-wheeler was at fault. The driver of the 18-wheeler's driving history contained a number of violations including 2 DWI's. There were at least 66 citations issued to the company which employed the driver of the 18-wheeler, 6 of which pertained to the driver.

Injuries:
The husband was diagnosed with a left humeral shaft fracture, left upper extremity compartment syndrome, right open distal radius fracture with right flexor tendon damage and radial nerve palsy. The husband endured multiple surgical procedures including an open reduction internal fixation of the left humeral shaft, an internal fixation plate on the upper humerus and an internal fixation of the right distal radius. The husband sustained permanent disfigurement in the form of scarring. The husband's medical bills exceeded $122,000.00. He was unable to work.

The wife suffered a right tibial plateau fracture and a bimalleolar right ankle fracture. As a result, she endured surgery in the form of an open reduction internal fixation of the right tibial plateau fracture and an open reduction internal fixation of the bimalleolar right ankle fracture. She also sustained permanent disfigurement and was unable to work.
