Product Liability

What is a "defective" product?

The legal definition is a product that is "unreasonably dangerous for its intended use." What does that mean? Cars aren't supposed to explode, tires shouldn't blow out, seat belts are supposed to stay buckled. These are a few examples of products failing to do what they are intended.

When a manufacturer puts a product on the market, they are, in effect, giving you a warranty. They are guaranteeing that the product was manufactured and designed without a defect. However, many times while a product is being produced, something occurs during manufacturing that creates a serious problem. For example, the wrong size bolt is used to hold a drive shaft in place, causing excessive vibration, which leads to catastrophic failure, or too much of a particular component is put into a drug supplement, causing liver or kidney failure. When designing a product, perhaps the manufacturer made the wheel base of a vehicle too narrow, causing it to roll over far too easily, or a car seat for children that allows for them to slide under the restraints during a crash.

At the Law Offices of Maloney & Campolo, we have worked on products liability claims for over 20 years. This area of the law is complex, and should only be handled by an experienced and dedicated firm who has the expertise to pursue these types of lawsuits.
