Pharmaceutical

Pharmaceutical — Part 1

A family member had a bad drug reaction to a drug, is there anything we can do about it?

Pharmaceutical litigation is something that I've been pursuing for the past 20 years. I'm very proud of the work I've done in this field. The pharmaceutical industry in the U.S. has undergone a serious transformation. What has happened is that pharmaceutical companies have become consumer companies. And what I mean by that is that I don't think you can turn on a television program without seeing a pharmacy ad or a pharmaceutical ad about a particular drug. Pharmaceutical companies now have to market a blockbuster product and get it out there and sell it regardless of the consequences. I don't know how many times that we've seen a Vioxx, or a Reslin, or a Baycol — drugs that were once thought have safe but have now been taken off the market because they turned out to be actually deadly.

If you or someone in your family has had a bad reaction caused by a pharmaceutical product, a drug, a prescription drug, I'd like to talk to you about it because there may be something I can do for you, or there may not. The primary basis of a pharmaceutical case is: What did the drug company know? When did they know it? Did they possess knowledge of study that indicated that the drug wasn't safe but went ahead and marketed it anyway because they had invested so much money in research they had to get it out there?

Pharmaceutical — Part 2

The pharmaceutical companies have lots of money. Can you really take them on??

I have for 20 years. I've represented hundreds and hundreds of people who've been devastated by them. It's not easy, it's intimidating and I have to admit they're a fierce opponent, but the truth of the matter is that I've always felt at the light of the day, when shined upon these companies, the truth will come out. The best example I have on that is recently Vioxx was pulled from the market. We fought a very long, hard battle over a number of years that resulted in a $4.4 billion dollar payout to injured people all across this country. Is it easy, no. Is it something that is impossible, no. We've proven we can take them on, we've proven that we can be victorious. It is a difficult, difficult piece of litigation and it's lengthy. The truth is that it's not something that most attorneys are equipped to handle. In fact, most attorneys when they have a pharmaceutical case refer them out to law firms like Maloney and Campolo. A number of our cases do come from other law firms. Why? Because it's very difficult, it's very time-intensive, and quite frankly you have to have a lot of experience in it or otherwise you're just not going to do it well.
