I've just been a car accident, what should I do?
The most important thing that you need to do in the event of an accident is to find out if anyone is hurt. If anyone has been injured, make sure that the police are dispatching the necessary emergency medical personnel to ensure everyone's health and safety. If you're needing a medical treatment, that's the first thing you've got to concentrate on. The lawsuit or litigation comes second, the first thing is make sure your family is OK.
The next question we usually get is, "Ok, I need to see a doctor but the truth of the matter is that I just don't have the money to do it. So, what are my options?" Surprisingly you've got a lot.. The first option is that your own insurance may contain PIP, and you may not even realize that you have it. PIP allows you up to $2500 to use on medical bills to make sure you're OK. If you don't happen to have that insurance, we also have access to physicians who will see under, what's called, a letter of protection. What that simply means is that these are physicians who understand the fact that people get into automobile accidents and may not be able to pay for the medical treatment they need right then. They will wait until the case settles and then accept payment at the end of the litigation. So don't be intimidated by the fact that you need to see a doctor but you don't think you can afford it. What is your law firm going to do for me after I've been in an accident?
You're not going to worry about dealing with the insurance company, you're not going to worry about getting a police report, or worry about your medical bills, or property damage. That's what you employ us for. Your job is really simple — get better, make sure your family is OK, get healthy to go back to work. What's my claim worth?
There's no exact formula to this answer. Have you missed any work? What are your medical bills? Can you go back to your job? Are you going to have to change employment? Have you suffered any disfigurement through any surgery or scars? Have you been injured to the extent that the things in life you used to enjoy you can't do anymore? Such as playing with your kids, going fishing, the enjoyment of life -these are the things that affects the value of your lawsuit. Everyone should hope when they get into an accident that they're going to get better right away. If unfortunately that doesn't happen, we'll evaluate it, we'll take all those factors into consideration, and then we'll get you a fair and reasonable settlement based on the injuries you sustained. How long will it take to get results?
It really depends on the nature of the accident. We always tell clients that it can take 90 days to a year. There's no set time. It really depends on the severity the accident, or whether or not the insurance is adequate, or whether you have to rely on your own insurance. The truth of the matter is that we won't candy coat anything for you. We're not going to tell you we're going to settle your case in 30 or 90 days just to get a quick fee. The case is going to resolve itself when you're ready. When the doctor has said that you are ready to go back to work, that you've healed from your injuries, and then we'll sit down and negotiate a settlement or we'll walk over to the courthouse and try your case.
